Throughout history, anthropologists have confronted a number of uncomfortable truths around the supposed nature of reality. The anthropological maxim, "through the study of others we learn more about ourselves" has been sorely tested en route. Arguably, this challenge reached culmination during the 1970s and 80s, with several prominent social commentators from Geertz to Clifford suggesting that anthropologists had, in both past and present, been much more concerned with the study of 'others' than of 'ourselves'. In essence, this reflexive critique suggested (...) that ethnographers were in the business of writing fiction and more insidiously came to the field equipped with a set of assumptions and presuppositions about the world in all its variety. These universal verities functioned to reduce all subjects of study into conformity with the observer's sense of what was real and of import and what was not and inconsequential. (shrink)

Current debates in Clinical Legal Education (CLE) exclude essay writing as a legitimate form of ‘clinical’ pedagogy. This article argues that essay writing should be classified as a form of CLE due to its potential to mirror legal practice and enhance students' reflective capacities. By incorporating Hegelian dialectical reasoning, the paper proposes a structured approach to legal essay writing that includes thesis, antithesis, and synthesis. This method encourages students to engage deeply with legal arguments, reflecting on their merits and counterarguments. (...) The article outlines the theoretical basis of this model and provides a practical framework for its implementation in legal education. Through this dialectical method, the paper advocates for a more holistic and nuanced understanding of legal concepts, bridging the gap between academic theory and practical application, and, thus, making the case for the incorporation of Hegel-inspired essay writing into the definition of CLE. BackgroundStory recall tests have shown variable sensitivity to rate of cognitive decline in individuals with Alzheimer’s disease biomarkers. Although SR tasks are typically scored by obtaining a sum of items recalled, item-level analyses may provide additional sensitivity to change and AD processes. Here, we examined the difficulty and discrimination indices of each item from the Logical Memory SR task, and determined if these metrics differed by recall conditions, story version, lexical categories, serial position, and amyloid status.Methodsn = 1,141 participants from (...) the Wisconsin Registry for Alzheimer’s Prevention longitudinal study who had item-level data were included in these analyses, as well as a subset of n = 338 who also had amyloid positron emission tomography imaging. LM data were categorized into four lexical categories, and by serial position. We calculated difficulty and discriminability/memorability by item, category, and serial position and ran separate repeated measures ANOVAs for each recall condition, lexical category, and serial position. For the subset with amyloid imaging, we used a two-sample t-test to examine whether amyloid positive and amyloid negative groups differed in difficulty or discrimination for the same summary metrics.ResultsIn the larger sample, items were more difficult in the delayed recall condition across both story A and story B. Item discrimination was higher at delayed than immediate recall, and proper names had better discrimination than any of the other lexical categories or serial position groups. In the subsample with amyloid PET imaging, proper names were more difficult for Aβ+ than Aβ−; items in the verb and “other” lexical categories and all serial positions from delayed recall were more discriminate for the Aβ+ group compared to the Aβ− group.ConclusionThis study provides empirical evidence that both LM stories are effective at discriminating ability levels and amyloid status, and that individual items vary in difficulty and discrimination by amyloid status, while total scores do not. These results can be informative for the future development of sensitive tasks or composite scores for early detection of cognitive decline. (shrink)

An electron clearly has the property of having a charge of þ1.6 10 19 coulombs, but does it also have the property of being charged ? Philosophers have worried whether so-called ‘determinable’ predicates, such as ‘is charged’, actually refer to determinable properties in the way they are happy to say that determinate predicates, such as ‘has a charge of þ1.6 10 19 coulombs’, refer to determinate properties. The distinction between determinates and determinables is itself fairly new, dating only to its (...) definition by the Cambridge logician W. E. Johnson early in the last century.1 But despite its newly minted condition the distinction has found little currency in on-going philosophical debates. Or at least until recently. Renewed interest in realist positions about properties, and arguments that the determinable-determinate relation may hold the key to understanding mental causation, have thrust Johnson’s distinction to the fore. With this new attention has also come new ‘optimistic’ positions that endorse the existence of determinable properties. David Armstrong, Evan Fales, and Sydney Shoemaker, among others, have all defended such optimistic accounts that take determinable predicates, such as ‘is charged’, to refer to determinable properties.2 In this paper, our goal is to carefully assess optimism and to argue that a pessimistic view, which rejects the existence of determinable properties, is actually the appropriate default position. One of the primary tasks of the philosopher is to explain what it is for something to be the case – what it is for one event to cause another, what it is for an action to be obligatory, what it is for an object to bear a property, what it is for a proposition to be true necessarily, what it is for a person to know something. This activity of explaining what something is or what it is for something (...) to be the case, of identifying what I call ontological explanations, is of special importance to metaphysics, since the task of metaphysics generally is to get to the bottom of reality. The concept of ontological explanation is usually buried a layer deep in most discussions, however, and theses about it are either presupposed or clothed as claims about other things. In some cases, this leads to confusion and frustration, and in many other cases the discussion could benefit from a long look at ontological explanation even if that look isn't strictly necessary to remedy confusion. My goal is to give ontological explanation that long look, and then use the clarity gained to reinterpret, reorganize, and even make progress on some long-standing disputes in metaphysics. In the first two chapters I examine ontological explanation itself and connect it to a host of important metaphysical issues, including ontological commitment and truthmaker theory. In the third and fourth chapters, I apply the work done in the first two chapters to a pair of important metaphysical arguments that crucially employ infinite regresses of ontological explanations – Bradley's Regress and McTaggart's Paradox. This paper draws an antigonal line leading from Sophocles’s Antigone to the lynching of Emmett Till. Drawing this line is an attempt to celebrate and honor that spirit of defiance in the name of loving the dead and memorializing loss. In particular, it takes up that portion of the line that centers on lynching. An overarching goal is thus to argue that lynching and its afterlives deserve more philosophical attention than they have received, especially from American philosophers. It is long (...) past time that philosophers take on lynching as a meaningful while volatile topic, especially insofar as it makes claims on the racial identities of the philosophers doing so. But rather than addressing lynching in general, this paper looks at one particular point on this line: the lynching of Emmett Till and the defiant mourning of his mother, Mamie Bradley. Doing so is meant to invite others to locate other points on this antigonal line. Upon sketching Sophocles’s play and Till’s murder, I consider some of the key features of Hegel’s influential interpretation. While philosophy has been mostly silent on lynching, Hegel’s Phenomenology provides essential, while problematic, material for initiating a philosophical approach to this neglected topic. Building on Hegel’s reading, I next consider the nature of “white law and order” and its complicity in extrajudicial murder and terror. Then I turn to Black mourning, where I explore what Fred Moten calls Mamie Bradley’s “Black Mo’nin”—her antigonal refusal of the white drive to annihilate Black life—and consider her as a practitioner of Christina Sharpe’s notion of “wake work.” I then turn to an artistic intervention in lynching photography to take up Sharpe’s challenge for how to respectfully engage lynching given different racial identities. Finally, I conclude by sketching an opening for a possible next antigonal point: the work of Ida B. Wells. (shrink)

Oxford: Clarendon Press, 1996. vii 1 510 pp. Cloth, $85.Gill’s book is a wide-ranging attempt to improve our understanding of Greek poetic and philosophical thinking about the self and its role in ethics. His thesis is that the Greeks had an “objective-participant” model (...) of personality which is different in important ways from the various “subjective” and/or “individualist” models which have often formed the basis of modern interpretations. While the subjective understanding of the person privileges a unitary first-person perspective in a Cartesian way, Gill argues that the Greeks—as do some modern thinkers—speak of an interplay between parts that is best studied from the outside. The individualist strand of thought makes individual autonomy a keystone of morality in a way indebted to Kant; Gill argues that the more communal mode of ethics advocated recently by Williams and MacIntyre is closer to the Greek ideal. Gill is surely right that Cartesian and Kantian assumptions have had a distorting effect on some readings of Greek texts, and he has made important progress by presenting a different framework based on modern work touching on Greek thought about ethics and the self.After an introduction spelling out his objective-participant framework Gill devotes his first chapter to Homeric decision-making and a critique of the interpretations of Snell and Adkins. It is a mistake, he argues, to make self-consciousness the criterion for a full-blown concept of the self or for what counts as moral decision making. Homeric deliberations are closer in form to Aristotle’s thinking about decision making and the modern action theory which has reasons (whether conscious or not) replace the will as the basis for action. Nor are the Homeric heroes rightly criticized for allowing shame and their status to be considerations in their decision making; as Williams has argued, internalized shame can be a rather effective ethical motivator, and as both he and MacIntyre have argued, there is much to be said for allowing one’s place in society to inform one’s decision making. Gill’s argument here does not seem particularly novel, as his frequent citation of Williams and MacIntyre makes clear, but he does apply it thoroughly to four important Iliadic monologues in a way which clarifies these ideas and confirms their relevance for Homer.The second chapter provides an analysis of why we feel sympathy for the problematic heroes of Greek epic and tragedy, particularly Achilles and Medea, despite their controversial deeds. Here Gill rejects the views of Bradley and Butcher, who argued that it was the power of the character’s self-conscious personality that won us over, and the structuralist view of Redfield, who made [End Page 119] Achilles a mediator between the need to protect society and the desire for personal glory. Gill interestingly—and originally, as far as I know—argues that it is rather the hero’s acting out of an ethically exemplary gesture, based on implied or explicit second-order reasoning about the best sort of human life, that gains our interest and sympathy. For Gill it is important that the hero’s ethical position fall within the communal framework of his or her society: Achilles’ refusal to return to the fight is his way of showing how Agamemnon has undermined the code of heroic reciprocity; Medea’s murder of her children is, even more paradoxically, her means of showing Jason the importance of the bonds of philia.Taking Achilles as our example, Gill rejects the view of Parry and Whitman that Achilles’ heroism is deeply subjective. Gill argues that Achilles, in his great speech of book 9, is not rejecting the heroic code itself but only Agamemnon’s perversion of it. While this reading makes good sense of much of Achilles’ speech in Iliad 9, it is difficult to square with the end of the speech, in which Agamemnon seems to have faded from view, leaving Achilles to question the heroic code itself. This book's subtitle, as well as its inclusion in Yale University Press's philosophy catalog, creates the expectation of a philosophical match between, in one corner, the ideas of Michael Oakeshott and Leo Strauss and, in the other, the ideas of such "postmodernist" thinkers as Michel Foucault, Jean-Francois Lyotard, Jacques Derrida, and Richard Rorty, and behind them such gray eminences as Heidegger and Kojève. One soon discovers, however, that Devigne deals not with philosophical responses to postmodernism, but with political responses to (...) postmodernity--a sociological category described only in the most superficial terms. Devigne's account of these political responses is further constricted by his method of treating Strauss's ideas in the context of American conservatism and Oakeshott's ideas in the context of British conservatism. Thus, instead of illuminating the meaning of Strauss's work in the light of Plato, Farabi, and Maimonides, Devigne places him in the company of such writers as Daniel Bell, James Q. Wilson, and Michael Novak. In his chapter on Oakeshott, Devigne only superficially connects Oakeshott to Hobbes, Hegel, and Bradley, while failing to mention Augustine and Montaigne, but he does manage to devote a third of a page to the arcana of the British budget between 1971 and 1977. Recasting Conservatism is, in short, less a work of political philosophy than a work of political science or sociology. (shrink)

T. H. Green was a leading member of the British Idealist movement, which adopted the continental philosophy of Hegel and Kant while rejecting utilitarianism. As well as being a prominent philosopher, Green was an influential educational reformer and an active member of the Liberal party. Green's writings can be placed into three categories: religion, philosophy and politics. This work was the most complete statement of Green's philosophy, although it remained unfinished at his death. Edited by A. C. Bradley, a (...) former student and brother of Green's fellow Idealist F. H. Bradley, the book, which contains four parts, was published posthumously in 1883. There are over 800 seventh to tenth grade students at the College d’Enseignment Generale (CEG) School in Azové, Benin. Like most children in the developing world, these students lack access to clean water and basic sanitation facilities. These students suffer from parasitic infection and health ailments which could be directly offset with short term aid to supply water and medical aid. Promoting proper sanitation and providing the technology to implement water and wastewater treatment in the community will decrease childhood and (...) maternal disease and mortality rates in Azové. However, these measures may take several years to implement and will require a significant investment in the infrastructure of the school. Is it ethical to spend $10,000 towards the long-term goals of providing water and sanitation to the students of CEG Azové, compared to spending the same amount on short-term relief efforts? (shrink)

David Lowenthal offers a serious treatment of the idea that Shakespeare was a serious thinker, indeed a philosopher who chose to develop his ideas in dramatic form. Readers accustomed to contemporary Shakespeare criticism may be puzzled by Lowenthal’s book. He makes no effort to historicize his discussion of Shakespeare and never invokes the unholy trinity of race, class, and gender in analyzing the plays. Compared to new historicist, feminist, Marxist, and deconstructionist critics of Shakespeare, Lowenthal may seem to be a (...) naive reader; he is looking for what he can read out of the plays, not what he can read into them. Grounding himself in the older tradition of Shakespeare criticism, from Ben Jonson to Samuel Johnson, from Samuel Taylor Coleridge to A. C. Bradley, Lowenthal views the playwright as a source of genuine wisdom. He assumes that Shakespeare knew what he was doing and was fully in control of his dramatic material, shaping his plays into artistic wholes that allow him to raise fundamental questions about the human condition. This paper presents a new theory of modal reasoning, i.e. reasoning about what may or may not be the case, and what must or must not be the case. It postulates that individuals construct models of the premises in which they make explicit only what is true. A conclusion is possible if it holds in at least one model, whereas it is necessary if it holds in all the models. The theory makes three predictions, which are corroborated experimentally. First, conclusions (...) correspond to the true, but not the false, components of possibilities. Second, there is a key interaction: it is easier to infer that a situation is possible as opposed to impossible, whereas it is easier to infer that a situation is not necessary as opposed to necessary. Third, individuals make systematic errors of omission and of commission. We contrast the theory with theories based on formal rules. (shrink)

This paper describes differences in two perspectives on the idea of virtue as a theoretical foundation for positive organizational ethics (POE). The virtue ethics perspective is grounded in the philosophical tradition, has classical roots, and focuses attention on virtue as a property of character. The positive social science perspective is a recent movement (e.g., positive psychology and positive organizational scholarship) that has implications for POE. The positive social science movement operationalizes virtue through an empirical lens that emphasizes virtuous behaviors. From (...) a virtue ethics perspective, a behaviorally based account of virtue is a weak theory of virtue. Observations are suggested for integrating the two perspectives. First, virtue should always be understood as an excellence and is often an optimal point between extreme dysfunctions on continuum of potential states. Second, an empirical exploration of virtue needs to account for character and context. Finally, the properties of organization-level virtue need to be further specified and explored. Multiple scholars and institutions have asked what distinguishes public health research from public health practice. Most often, they ask in order to have a clear definition of what one does in various public health settings to assess oversight and/or regulation of human subjects research. More importantly, however, whether something is considered public health research or public health practice has real ethical implications in terms of the general moral considerations at stake and the obligations of public health researchers/practitioners to the populations (...) they serve or study.Numerous examples in recent history of research ethics, including the Kennedy Krieger Lead Abatement Study and EPA’s Children’s Environmental Exposure Research Study, suggest that an exploration of the ethics of public health, or more generally population-based research, may be warranted. Although we acknowledge that there are important ethical issues to consider in the implementation of public health practice, we leave that discussion for other authors. (shrink)

In this paper we argue that surgeons face a particular kind of within-role conflict of interests, related to innovation. Within-role conflicts occur when the conflicting interests are both legitimate goals of professional activity. Innovation is an integral part of surgical practice but can create within-role conflicts of interest when innovation compromises patient care in various ways, such as by extending indications for innovative procedures or by failures of informed consent. The standard remedies for conflicts of interest are transparency and recusal, (...) which are unlikely to address this conflict, in part because of unconscious bias. Alternative systemic measures may be more effective, but these require changes in the culture of surgery and accurate identification of surgical innovation. (shrink)

This experiment examined the effects of three elements comprising Jones' (1991) moral intensity construct, (social consensus, personal proximity, and magnitude of consequences) in a cross-cultural comparison of ethical decision making within a human resource management (HRM) context. Results indicated social consensus had the most potent effect on judgments of moral concern and judgments of immorality. An analysis of American, Eastern European, and Indonesian responses also indicted socio-cultural differences were moderated by the type of HRM ethical issue. In addition, individual differences (...) in personal ethical ideology (relativism and idealism) varied reliably with moral judgments after controlling for issue characteristics and socio-cultural background. Facial emotion recognition (FER) deficits interfere with interpretation of social situations and selection of appropriate responses. Attention-Deficit/Hyperactivity Disorder (ADHD) symptoms are independently associated with social difficulties and might exacerbate the influence of deficient FER, because children with ADHD symptoms have fewer compensatory resources in social situations when they misinterpret emotions. Very few studies have tested this hypothesis in a community context, where child ADHD symptoms vary on a continuum. The current study extended this work by utilising a community sample (N (...) = 87) of boys and girls in middle childhood (M = 7.83 years) and testing for moderation of FER effects separately by ADHD symptom type (ADHD-I = inattentive, H = hyperactive/impulsive, C = combined) using linear regression. While lower FER was associated with more social problems, this relationship was qualified by the presence of ADHD symptoms. Specifically, only children with relatively high ADHD symptoms in our community sample showed this inverse relationship, which was clearest among children with elevated ADHD-C or ADHD-I symptoms. No gender differences were observed. These results support our primary hypothesis, extend prior findings to boys and girls in the community, and have implications for understanding how ADHD symptoms and FER influence youth social deficits. This book addresses several dimensions of the transformation of English Nonconformity over the course of an important century in its history. It begins with the question of education for ministry, considering the activities undertaken by four major evangelical traditions to establish theological colleges for this purpose, and then takes up the complex three-way relationship of ministry/churches/colleges that evolved from these activities. As author Dale Johnson illustrates, this evolution came to have significant implications for the Nonconformist engagement with its message (...) and with the culture at large. These implications are investigated in chapters on the changing perception or understanding of ministry itself, religious authority, theological questions, and religious identity.In Johnson's exploration of these issues, conversations about these topics are located primarily in addresses at denominational meetings, conferences that took up specific questions, and representative religious and theological publications of the day that participated in key debates or advocated contentious positions. While attending to some important denominational differences, The Changing Shape of English Nonconformity, 1825-1925 focuses on the representative discussion of these topics across the whole spectrum of evangelical Nonconformity rather than on specific denominational traditions.Johnson maintains that too many interpretations of nineteenth-century Nonconformity, especially those that deal with aspects of the theological discussion within these traditions, have tended to depict such developments as occasions of decline from earlier phases of evangelical vitality and appeal. This book instead argues that it is more appropriate to assess these Nonconformist developments as a collective, necessary, and deeply serious effort to come to terms with modernity and, further, to retain a responsible understanding of what it meant to be evangelical. It also shows these developments to be part of a larger schema through which Nonconformity assumed a more prominent place in the English culture of the nineteenth and early twentieth centuries. With most states now making sex offender registration information available to the public, journalists must balance their obligation to inform the public about potential dangers with respect for individuals' rights. This article examines the problems journalists face in truth telling and minimizing harm and offers suggestions for covering community notification. At minimum, we suggest journalists verify the accuracy of information received from police, make independent judgments about whether or not publication of sex offender registration information is warranted, and provide background (...) information on the scope and effectiveness of community notification in their areas. Often machine learning programs inherit social patterns reflected in their training data without any directed effort by programmers to include such biases. Computer scientists call this algorithmic bias. This paper explores the relationship between machine bias and human cognitive bias. In it, I argue similarities between algorithmic and cognitive biases indicate a disconcerting sense in which sources of bias emerge out of seemingly innocuous patterns of information processing. The emergent nature of this bias obscures the existence of the bias itself, (...) making it difficult to identify, mitigate, or evaluate using standard resources in epistemology and ethics. I demonstrate these points in the case of mitigation techniques by presenting what I call ‘the Proxy Problem’. One reason biases resist revision is that they rely on proxy attributes, seemingly innocuous attributes that correlate with socially-sensitive attributes, serving as proxies for the socially-sensitive attributes themselves. I argue that in both human and algorithmic domains, this problem presents a common dilemma for mitigation: attempts to discourage reliance on proxy attributes risk a tradeoff with judgement accuracy. This problem, I contend, admits of no purely algorithmic solution. (shrink)

One hundred and three participants solved conflict and non-conflict versions of four reasoning tasks using a two-response procedure: a base rate task, a causal reasoning task, a denominator neglect task, and a categorical syllogisms task. Participants were asked to give their first, intuitive answer, to make a Feeling of Rightness judgment, and then were given as much time as needed to rethink their answer. They also completed a standardized measure of IQ and the actively open-minded thinking questionnaire. The FORs of (...) both high- and low-capacity reasoners were responsive to conflict, such that FORs were lower for conflict relative to non-conflict problems. Consistent with the quantity hypothesis, high-capacity reasoners made a greater distinction between conflict and non-conflict items on measures of Type 2 thinking, namely, rethinking time and probability of changing answers. In contrast to the quality hypothesis, however, this rethinking time did not advantage the ability of the high-capacity group to produce normative answers, except for the base rate task. Indeed, we observed that the correlation between capacity and the probability of normative answers emerged at the initial response, rather than after rethinking. (shrink)
